Our team led by Advocate Nitesh Jain and Mr. Jatin K Goyal, (Founders and Managing Partners) recently secured a significant victory against the Government of Uttar Pradesh and the Greater Noida Industrial Development Authority (GNIDA) before the Hon’ble High Court of Allahabad, Lucknow Bench.
The bench of Hon’ble Justice Alok Mathur criticized the UP Government for its lack of impartiality, observing that its actions reflected the role of a spokesperson for GNIDA rather than that of an independent authority conducting a fair evaluation of the matter. The Court also expressed concern over the appointment of officials who lacked the requisite seniority and capability to deal with matters of such significance.
Our client, Oriental Structural Engineers Pvt. Ltd. (Central Park Group), had a long-pending dispute with the Greater Noida Industrial Development Authority (GNIDA) concerning its corporate office plot at Techzone IV. Despite allotment of the plot, actual physical possession was never delivered by GNIDA. Through a carefully developed legal strategy and persuasive arguments, our team secured a judgment addressing critical issues relating to possession and the implementation of the Zero Period Policy.
We successfully demonstrated that GNIDA had not taken actual physical possession of the land from the landowners during the acquisition process and that the possession certificate issued to the client lacked independent verification and substantive supporting action, thereby violating the petitioner’s legal rights. We further highlighted GNIDA’s refusal to extend the benefits of the Zero Period Policy, which significantly aggravated the petitioner’s financial burden.
The High Court, acknowledging the merits of the case, held that GNIDA could not levy interest on dues accrued during the disputed period in the absence of physical possession. The Court further directed GNIDA to extend the benefits of the Zero Period Policy, hand over physical possession of the plot within two weeks of receipt of the certified copy of the judgment, and issue a revised demand letter after accounting for payments already made by the petitioner.
